物权化之后的土地承包经营权,仍然受到农村集体经济组织成员身份的制约。在成员身份的制约之下,土地承包经营权制度难以消除其在权利稳定与权利平等之间、权利固化与人口流动之间、土地利用与农民生存保障之间的内在冲突,农民的土地权益的实现和土地利用效率的提高也因此遭受严重不利影响。农村经济社会条件的变化、农民生活条件的改善和生存空间的拓展,为切割身份与土地承包经营权的关联提供了条件。实现土地承包经营权的长久化或者永久化是实现这种切割的有效途径。

Land contractual management right into real right is still restricted by the status of the members of the rural collectives. Under the status restriction of the members, it is difficult for the system of the land contractual management right to eliminate the internal conflict between right stabilization and right equality, between right solidifying and population movement, and between land utilization and farmer living security, which thus results in grievous adverse effect on realization of the farmers’ interests in land and raising of land utilization efficiency. Change of rural economic and social conditions, improvement of farmer living conditions and expanding of living space, has laid a good foundation for cutting the linkage of the status and the land contractual management right. Maintaining long time or permanent land contractual management right is an effective approach to realization of such cutting.
