新律师法关于辩护律师阅卷权的规定与刑事诉讼法及其相关司法解释存在明显冲突,新律师法关于辩护律师阅卷权的规定本身也还存在不足。为了保证辩护律师能充分履行辩护职能,必须进一步完善辩护律师的阅卷权的规定。
新律師法關于辯護律師閱捲權的規定與刑事訴訟法及其相關司法解釋存在明顯遲突,新律師法關于辯護律師閱捲權的規定本身也還存在不足。為瞭保證辯護律師能充分履行辯護職能,必鬚進一步完善辯護律師的閱捲權的規定。

There exist conspicuous conflicts in provisions regarding the defense attorneys＇ right of reading case records stipulated in the new Law of PRC on Lawyers and the Criminal Procedural Law and relevant judicial interpretations.Meanwhile,provisions regarding this right stipulated in the new Law on Lawyers are defective.In order to ensure that the defense attorneys can fully execute their duties,provisions regarding their right of reading case records should be improved.
