＂刑＂ ; interpretation; the late Qing dynasty and the Republic of China; new China
“刑”字蕴含着丰富的法文化信息。就所见资料来看，民国时期学者倾向于认为“刑”有法的意思，而新中国成立后学界一般认为“刑”兼有法与罚两重含义。但不论是近代还是现代，都缺乏对“刑”字含义进行专门、系统、详细论证的成果，对“刑”字含义的完整流变也没有一个清晰的脉络。
“刑”字蘊含著豐富的法文化信息。就所見資料來看，民國時期學者傾嚮于認為“刑”有法的意思，而新中國成立後學界一般認為“刑”兼有法與罰兩重含義。但不論是近代還是現代，都缺乏對“刑”字含義進行專門、繫統、詳細論證的成果，對“刑”字含義的完整流變也沒有一箇清晰的脈絡。
“형”자온함착봉부적법문화신식。취소견자료래간，민국시기학자경향우인위“형”유법적의사，이신중국성립후학계일반인위“형”겸유법여벌량중함의。단불론시근대환시현대，도결핍대“형”자함의진행전문、계통、상세론증적성과，대“형”자함의적완정류변야몰유일개청석적맥락。
The word of ＂刑＂ in Chinese contains abundant information of legal culture. According to the materials we found, scholars in the peroid of the Republic of China were inclined to the idea that ＂刑＂ had the meaning of ＂law＂ ; but most scholars in new China thought it had two meanings： ＂law＂ and ＂penalty＂. Now we laek special and systematic researches on its meanings and the historical evolution of its meanings.
