企业国有资产监管法律责任因其监管主体的不同而有差异，其中最为突出的是违宪责任问题。相应的，企业国有资产监管主要包括行政救济程序和司法救济程序。长期以来，包括企业国有资产监管在内的经济法具体制度之所以缺乏可诉性，问题不在于经济法没有独立的诉讼程序，而在于我国缺乏违宪审查程序、公益诉讼制度以及私益诉讼制度的司法保障不足。除了传统的民事诉讼、行政诉讼和刑事诉讼，违宪审查程序和公益诉讼制度理应成为企业国有资产监管法律责任及救济制度构建的当务之急。

There are differences to the liability of the regulation of the state-owned assets of the enterprises for the differences of the regulatory body, the most prominent problem is the constitutional responsibilities. Accordingly, the regulation of the state-owned assets of the enterprises mainly includes the administrative relief procedure and judicial relief procedure. For a long time, the reason for lack of justiciability of specific systems of economic law, including the regulation of the state- owned assets of the enterprises, does not lies in no independent proceedings of economic law, but lies in the lack of constitutional review procedure, public interest litigation system and the inadequate judicial protection in private interest litigation system. In addition to traditional civil action, administrative action and criminal action, the constitutional review procedure and the public interest litigation system should become a top priority of the construction of the liability and relief system of the regulation of the state-owned assets of the enterprises!
