国外民事立法中,一般都有对胎儿人格权的延伸保护的法律规定。关于胎儿权益保护的理论依据,主要有三种学说,即生命法益保护说、权利能力说以及人身权延伸保护说,近来又有分期保护说。胎儿作为即将出世的未来公民,慈母般的民法典应当将对公民人格利益的保护向前延伸,赋予胎儿特殊的民事权利能力,并提供有力救济以满足其所受损害之赔偿请求权。

In the civil legislation of abroad, there are specific legal provisions concerning the extended protection of fetal human rights normally. Theory of legal interest protection for life, civil fights capacity and extension protection for personal fight make up the theoretical basis about it, and lately a new theory of protection by installment has ap- peared. Foetuses, as soon - to - be - born citizens in the future, civil code of our country should be strengthened further to prevent personality interests of them, endow foetuses with the capacity for civil fights fully, and provide efficient relief for foetuses to satisfy the request of asking for remedies and compensation that they suffered.
