民族自治地方自治条例和单行条例地方立法是非物质文化遗产教育自治权实现的保障。土家族民族自治地方已制定自治条例和单行条例,初步奠定了土家族非物质文化遗产教育自治权地方立法保障的基础。土家族非物质文化遗产教育自治权地方立法在立法价值、权利主体、权利内容、权利保障等方面仍有不足,需从理论基础和制度建构方面加以完善。

Autonomous regulations of ethnic autonomous regions and specific regulations for autonomous legislation are the safeguards for autonomy in education of intangible cultural heritage.Both autonomous and specific regulations have been set up in Tujia autonomous areas.They have formed the foundation for protecting local legislation of autonomy in education of intangible cultural heritage of the Tujia ethnic group.There are still some defects in the legislation in terms of legislation value,subject of right,content of right and protection of right.Optimization should be made in both basic theory and system construction.
