主动引渡作为国际刑事司法合作的一种机制，已成为我国打击腐败犯罪、缉拿外逃罪犯的重要手段。虽然我国在建立和完善主动引渡制度上取得了一些成功的经验，但仍然面临死刑不引渡、条约前置主义等国际引渡基本原则带来的一系列问题。为了寻求全球范围内缉捕外逃犯罪嫌疑人的有效途径，我国应当尽量以双边条约形式将引渡机制法治化，减少引渡实践中的政治性与行政性，构建符合我国国情的主动引渡机制。

Aetive cooperation in the extradition of international criminal justice as a mechanism to fight corruption in China has become an important means of tracking down criminals escape. Although our initiative in the establishment and improvement of the extradition system experiences some success, but still face a series of problems, such as some basic principles of the interna- tional extradition cooperation. To effectively fight corruption crimes, and seek an effective way arresting escaped criminal to a global scale, China should try to form a mechanisms for the rule of law and reduce political and administrative effection, then construct the active extradition mechanism which in line with our national conditions.
