人权价值是宪法的目的价值、核心价值,这决定了刑法目的是保护包括犯罪人在内的全体公民的基本人权。目前,我国刑事司法领域存在片面理解人权、忽视人权甚至侵犯人权等问题,破解问题之通途在于,建立保护与保障统一,情、理、法融合及以罪过原则为本的人权刑法解释观。目的解释作为这种解释观的根本方法,寓于法理与情理、规范与事实的类推过程之中。

As the targeted and core values of the constitution,values of hunman rights decide the purpose of criminal law： to protect the basic human rights of all citizens,including those of the criminals.In the field of present crininal justice,there exist such phenomena as one-sided understanding,neglect and even vialation of human rights.To solve these problems we should establish an outlook of criminal law＇s legal interpretation based on human rights,which unifies protection and security,integrates emotion,reason and law,and abides by the sins principle.Teleological interpretation,as the fundamental means of such interpretation,should be taken in the process of analogy of such relations like legal principles and emotion as well as standards and facts.
