前科制度同为中国与俄罗斯联邦刑法中未成年人刑事责任制度的重要内容,我国刑法第100条对此做了高度概括的规定,无适用对象之别,也不存在消灭问题,对于前科的概念也有多种认识;俄罗斯联邦刑法典于第86条、95条对前科概念、前科的消灭与撤销、未成年人前科制度等问题进行了规范,将前科概念法定化,前科是可以消灭或者撤销的;特别是其对未成年人前科制度的专门规定,较为宽缓而彻底,可以激励有前科的未成年人弃恶从善,值得我们借鉴。

The criminal record system is an important part in the system of Minor Criminal Responsibility which is in both the Criminal Law of PRC and the Criminal Code of Russian Federation.The Criminal Law of PRC,Art 100 gives an extremely general provision on this topic.It doesn＇t reveal the difference of the object and the problem of cancellation.There is lots of understanding to the notion of criminal record.The Criminal Code of Russian Federation Art 86 Art 95 prescribe the concept,cancellation,revocation and the problem of minor criminal record system.The provisions make the notion of criminal record statutory.They hold the opinion that the criminal record can be cleaned and abolished.Particularly,the provision,about the minor criminal record system,is lenient and complete.Therefore it can encourage the minors to pursuit the kind instead of the evil.It is worth referring for us.
