陆源污染的来源并不仅仅局限于海岸带或海洋地区,其具有典型的外来性。它不仅严重危及人们的健康与福祉,更直接危及到靠海生存的人们健康与资源安全。陆源污染对公众健康的危害,不仅导致某些疾病多发、海洋食物不安全、可以供人类使用的各种资源减少,也可能直接或间接影响公众社会心理健康。虽然我国一直十分关注陆源污染防治问题,但陆源污染的发展态势显然超出了我国政策与法律监管的程度。我们不仅存在着法律对策整体偏软的问题,而且面临着公众健康权受到侵害后救济不力、救济体系不完备等问题。

Marine pollution from land-based activities（MPLBA） is almost outside of the ocean and coastal zone,most of that land-in coastal areas and further inland.MPLBA jeopardizes the health,well-being and sometimes the very survival of people and the natural resources they depend on for subsistence.The major damages to public health from MPLBA conclude： unsafe seafood,increased additive risk of illness,reduced the resources.Another serious public concern from MPLBA is the social and psychological in local.China has been very concerned about the prevention and control of MPLBA,while it is outstripping solutions in China.These questions also remain such as the weak implementation of legal and relief.
