在广西北部湾经济区快速发展、“人地矛盾”日益突显的背景下,现行土地审批制度在实践中的弊端不断显现,主要表现在:土地审批环节多、时间长;建设用地审批受其它前置审批制约较严重;后期监管演变成前置审查,影响用地审批;风景区保护等基本上保持原用途的项目难于完成报批工作。为解决现行土地审批制度存在的问题,建议实行土地“征转分离”制度,优化用地审批程序、简化用地报批材料。实行“只征不转”土地征收模式,完善“先行用地”政策,实行“五年一审批”政策,强化民生意识、坚持依法审批,以更好地为北部湾经济区开发开放提供用地保障。
在廣西北部灣經濟區快速髮展、“人地矛盾”日益突顯的揹景下,現行土地審批製度在實踐中的弊耑不斷顯現,主要錶現在:土地審批環節多、時間長;建設用地審批受其它前置審批製約較嚴重;後期鑑管縯變成前置審查,影響用地審批;風景區保護等基本上保持原用途的項目難于完成報批工作。為解決現行土地審批製度存在的問題,建議實行土地“徵轉分離”製度,優化用地審批程序、簡化用地報批材料。實行“隻徵不轉”土地徵收模式,完善“先行用地”政策,實行“五年一審批”政策,彊化民生意識、堅持依法審批,以更好地為北部灣經濟區開髮開放提供用地保障。

In the context of rapid development of Guangxi Beibu Gulf Economic Zone and the increasing contradiction between more population and less land, the malpractices of present land survey and approv- al policy appears gradually, which mainly displays in the following aspects: the land survey and approval has too many links and processes and needs a lengthy time; the survey and approval for construction land are seriously constrained by other prepositioned survey and approval; the post-supervision is usually changed into prepositioned survey and approval, which greatly affects land survey and approval; scenic protection project, which basically maintains the original purpose, is difficult to reach the requirement of the approval. In order to solve the existing problems of land survey and approval policy and better provide the land safe- guard for Beibu Gulf Economic Zone' s development, this paper suggests to implement "the separation of land transfer from expropriation" policy, optimizing land survey and approval process, and simplifying the approval materials. The implementation of "land expropriation only but not land transfer" can be used as a mode of land acquisition, so as to improve the policy of "utilizing the land before its formalities are gone through", implement the policy of "survey and approval per five years", and finally strengthen the awareness of people's livelihood under the principle of carrying out the survey and approval system legally.
