国家在《国家中长期教育改革和发展规划纲要（2010-2020年）》中明确提出了＂高等教育去行政化＂的改革目标。何谓高等教育行政化？高等教育行政化有何影响？成因为何？在对以上疑问作出解答之外,更重要的问题在于如何将高等教育去行政化的改革转化为现实的制度设计。在这一过程中,要以政策手段和法律手段做为推进改革的基本进路。毋庸置疑,作为核心视角的法律规制是改革成功与否的关键策略。

In The Mid- and Long-term Plan for National Talent Development （2010-2020）, which is promulgated lately, the state determined the reform aim of de-administration of higher education. What is the administration of higher education？ What its effects and cause of formation？ Besides answering such questions, the most important issue is how to change the reform aim into practical system. In the process of reform, several misconceptions should be avoided first. Further, policies and laws should function as main drive forces. Legal regulation is without doubt a key factor that decides whether the reform aim can be reached or not. In addition to the improvement of legislation, the research on soft law and the concept of governance also provide a particular angle to analyze this issue.
