检察能动是指检察机关在涉及社会整体利益的领域,不拘泥于现有法律的规定,积极主动地行使检察权,通过不同方式参与司法审判的形式以维护社会公共利益、促进实质公平的司法理念。检察能动性的发挥是经济法案件的特殊性所决定的,经济法案件中发挥检察能动的合理性显而易见。当然,检察能动性的发挥,应当在特定的范围内进行,既要明确检察能动的向度,也要明确检察能动性发挥的限度。
檢察能動是指檢察機關在涉及社會整體利益的領域,不拘泥于現有法律的規定,積極主動地行使檢察權,通過不同方式參與司法審判的形式以維護社會公共利益、促進實質公平的司法理唸。檢察能動性的髮揮是經濟法案件的特殊性所決定的,經濟法案件中髮揮檢察能動的閤理性顯而易見。噹然,檢察能動性的髮揮,應噹在特定的範圍內進行,既要明確檢察能動的嚮度,也要明確檢察能動性髮揮的限度。
검찰능동시지검찰궤관재섭급사회정체이익적영역,불구니우현유법률적규정,적겁주동지행사검찰권,통과불동방식삼여사법심판적형식이유호사회공공이익、촉진실질공평적사법이념。검찰능동성적발휘시경제법안건적특수성소결정적,경제법안건중발휘검찰능동적합이성현이역견。당연,검찰능동성적발휘,응당재특정적범위내진행,기요명학검찰능동적향도,야요명학검찰능동성발휘적한도。
Judicial initiative means a judicial idea that when procuratorial organ deals with cases involving the interests of society as a whole,not rigidly adhering to the provisions of existing law,but to exercise procuratorial authority initiatively by attending the adjudgement of justice in different ways to protect public interests and promote the fairness of justice substantially.The exertion of judicial initiative of procuratorial organ is determined by the special nature of the economical case,and its rationality is obvious in economical cases.But it＇s self-understanding that the exertion of judicial initiative of procuratorial organ should be limited to a special scope,therefore,it is necessary to definitude the dynamic dimension and the limits of judicial initiative.
