Relationship between Procuratorates and Courts; Supervision-oriented; Trial-Centered; Constitutional Systems
围绕检、法两院关系的重构,理论界和实务界形成了两种不同的改革方案:监督本位型主张扩充检察权,使检察院成为法院之上的司法机关;审判中心型则主张以"控、辩、审"的诉讼架构重构检、法关系。但经过十余年的司法改革后,我国检、法两院的关系既未实现向监督本位型的转变,也未达到审判中心型的高度。检、法两院的关系重构涉及我国宪政国家体制的调整,在可预见的一段时间内并不具备彻底重构的条件,现行检、法关系的整体格局将长期维持现状。务实的司法改革应当考虑现行司法体制中检、法两院地位平等的事实,在现实的政治语境中基于合目的性的考量配置司法职权。
圍繞檢、法兩院關繫的重構,理論界和實務界形成瞭兩種不同的改革方案:鑑督本位型主張擴充檢察權,使檢察院成為法院之上的司法機關;審判中心型則主張以"控、辯、審"的訴訟架構重構檢、法關繫。但經過十餘年的司法改革後,我國檢、法兩院的關繫既未實現嚮鑑督本位型的轉變,也未達到審判中心型的高度。檢、法兩院的關繫重構涉及我國憲政國傢體製的調整,在可預見的一段時間內併不具備徹底重構的條件,現行檢、法關繫的整體格跼將長期維持現狀。務實的司法改革應噹攷慮現行司法體製中檢、法兩院地位平等的事實,在現實的政治語境中基于閤目的性的攷量配置司法職權。
위요검、법량원관계적중구,이론계화실무계형성료량충불동적개혁방안:감독본위형주장확충검찰권,사검찰원성위법원지상적사법궤관;심판중심형칙주장이"공、변、심"적소송가구중구검、법관계。단경과십여년적사법개혁후,아국검、법량원적관계기미실현향감독본위형적전변,야미체도심판중심형적고도。검、법량원적관계중구섭급아국헌정국가체제적조정,재가예견적일단시간내병불구비철저중구적조건,현행검、법관계적정체격국장장기유지현상。무실적사법개혁응당고필현행사법체제중검、법량원지위평등적사실,재현실적정치어경중기우합목적성적고량배치사법직권。
As to the relationship between Procuratorates and Courts,there are two reform approaches: one is Supervision-oriented model which advocates expansion of prosecutorial legal supervision powers so that the Procuratorates become judicial authority above the Courts,and the other is Trial-centered model which seeks to reconstruct the relationship according to the procedure structure.However,after more than ten years of judicial reform,neither of the approaches has succeeded.Reconstruction of the relationships between Procuratorates and Courts involves the adjustment of constitutional government systems with Chinese characteristics which are not likely to change in the foreseeable future,so the status quo will remain in the relationship between Procuratorates and Courts.Any realistic judicial reform should take into account the fact that Procuratorates and Courts are equal institutions in the present judicial practice,and allocate the judicial power between Procuratorates and Courts reasonably.
