由于中国目前还不具备实行强制律师代理制度的条件,故公民代理制度在目前的司法条件下实有其存在之必要。为了更好地规范公民代理人,保障当事人的诉讼权利,维护司法秩序,可以采取措施缩小公民代理的市场,并将现有的公民代理人纳入法律规范的轨道。通过对公民代理制度的改进,可以使这一制度更好地发挥作用,并为诉讼代理制度向强制律师代理制度平稳过渡作准备。
