各地地方性政策法规过度扩张宅基地使用权的初始取得主体范围,呈现出主体泛化的特征。以成员权为逻辑起点界定宅基地使用权初始取得的主体是防止主体泛化导致宅基地过度扩张和保护集体经济组织成员利益的诉求。现行宅基地使用权无偿配置方式不仅是对效率原则的违背,也是对可持续发展公平观的歧向与悖离。实行宅基地有偿配置是缓解土地资源供需矛盾的有效途径。宅基地使用权的初始取得以土地管理部门的行政程序即行政许可为必要,即以公权力的介入为必要。行政机关在审批宅基地使用权之时,应符合乡(镇)土地利用总体规划和村镇规划的相关规定。在宅基地使用权审批过程中强化土地用途管制无疑是加强土地资源保护,实现可持续发展的客观诉求。

As the scope for legal subjects to obtain initially the use right of house sites is excessively extended in local policies, the definition of legal subject tends to be generalized. To define the word "legal subject" who initially obtains the house site use right from the logic view of membership right is to prevent the excessive expansion of house site caused by the generalization of the word and to protect the appeal from collective economic organizations for membership benefits. The existing free allocation mechanism with respect to house site use right is an action not only violating the principle of efficiency, but also diverging from the sustainable development fair concept. Allocating house sites on a basis of consideration is an effective way to alleviate the supply-demand conflict of land resources. The initial obtainment of house site use right requires administrative procedures or administrative approval from land authority; in another word, it requires the intervention of public power. When the public power is used by administrative organizations for the purpose of approving house site use right, it shall comply with relevant regulations as set forth in the general plan for land utilization for villages ( and towns) and plans made by respective villages and towns. Consolidated land use control during the approval of house site use right in all cases will intensify the protection of land resources and help to achieve the objective appeal for sustainable development.
