侦查阶段,犯罪嫌疑人聘请律师是切实保证辩护权行使,保障犯罪嫌疑人权益的基本前提。但我国关于侦查阶段犯罪嫌疑人聘请律师程序的立法现状存在一定缺陷及其司法实践存在一定障碍,以致该程序运行严重受阻。因此,有必要从犯罪嫌疑人在侦查期间聘请律师的时间、主体、对象、内容和方式完善此程序,并构建法律监督机制、健全法律援助机制、确立律师推荐机制,以促进此程序有序推行。

In the investigation stage,criminal suspect＇s engaging a lawyer is the basis of ensuring the right of defense and protecting the rights of criminal suspect.Unfortunately,there have been certain shortcomings in both the legislation and the judicial practice in the procedure of engaging a lawyer for criminal suspect in the investigation stage in China,which has severely impeded the operation of this procedure.Therefore,it is necessary to improve the time,subject,object,centent and the method of this procedure,establish the legal supervision mechanism,strengthen the legal aid system and build the lawyers recommend mechanism.
