在知识的淘金热中，业界多有采用合作研发新技术模式者。我国专利法未明确规定专利共有的性质，由此引发了相关的权属纷争。专利权实为专利财产权，除当事人另有约定外，原则上应为按份共有。共有专利权与共有人对专利权所享有的份额是两个不同的概念，在共享专利的语境中，共有人对共有专利权能的实施不受其所享有份额的影响。此外，企业合作研发共享专利者还可能与专利法上的职务发明相抵触，由于专利法缺乏相关规定，如有纠纷，只能以激励创新的立法宗旨为导向，综合考虑、个案解决。
