刑事非法证据排除规则对防止违法取证行为、保障公民人权具有重要作用,我国宪法、刑事诉讼法和相关的司法解释对刑事非法证据的排除作出了规定,但仍存在着非法证据排除缺乏统一的立法体例、排除非法证据的规定不够全面、非法证据排除的程序不够详细、没有建立起非法证据排除的配套制度等问题,应该在立法上加以完善。

The exclusive rule of illegal-obtained criminal evidence plays an important role in preventing illegal evidence collection behaviors and safeguarding civil rights. Chinese constitution, criminal procedure law and relevant judicial interpretations have prescribed the regulations to the exclusion of illegal-obtained criminal evi- dence. However, the legislation system for illega! evidence elimination still lacks unification ; the exclusionary provision against illegal obtained evidence is not comprehensive enough; the exclusion procedure against illegal evidence is not specific enough; and the supporting system for eliminating illegal evidence has not yet set up. All of the above should be perfected in legislation.
