公共利益作为我国法律体系中的一个重要概念，由于没有明确的立法界定及其界定程序，在现实中引发了一系列带有普遍说明性的社会矛盾乃至冲突。对于公共利益的界定，应该从受益主体和利益内容两方面人手进行分析，公共利益具有整体性、非营利性、发展性和复杂性的特点，与国家利益、集体利益、社会利益以及共同利益有一定的区别。

Social contradictions or even conflicts in reality have successively emerged, involving public interest, an important concept in China＇s legal system, for lack of specific regulations and procedures. The definition of the public interest should start with its main beneficiary and contents. Public interest enjoys the integral, non-profit, developmental and complex nature, which is somehow different from the national interest, collective interest, social interest and common interest.
