当前检察机关开展的案件质量评查工作存在五个方面的问题:一是没有形成统一的评查标准;二是偏重于法律效果评查;三是评查结果只罚不奖;四是评查行政化运作;五是评查主体与被评查主体角色混同。问题的存在需要通过构建“三个效果”统一的案件质量评查机制来进行解决。在“三个效果”的统一思想指导下,应遵循司法规律原则、检察杈运行规律原则、评查与办案相分离原则、奖惩一体化原则要求,按照如何设计评查目标价值追求,然后由谁主导案件质量评杏工作,依据何种标准、遵照什么程序、采取哪种方法对哪些案件开展案件质量评查工作,最后如何运用案件质量评查结果进行奖惩的逻辑顺序来构建检察机关“三个效果”相统一的案件质量评查机制。

Nowadays, there are five questions in the case quality assessment mechanism in procuratorial organs: Firstly, there is no unified assessment standard. Secondly, there is improper emphasis on legal effect. Thirdly, there is too much emphasis on punishment. Fourthly, administrative operations are found. Fifthly, subjects and objects are mixed. It is necessary to establish the case quality assessment mechanism combined with "three effects" to resolve these questions. Guided by "three effects", according to the principle of judicial discipline, the principle of operation discipline of prosecutorial power, the principle of division of assessment and handling cases, and the principle of integration of punishment and reward, the authors discuss how to establish the case quality assessment mechanism combined with "three effects", following the logical order of the value pursuit of the subject, the subject who lead this job, the standard, the procedure, the method, the case which will be accessed, the punishment and reward by the result.
