法官回避制度，是为了消除当事人对法官中立性抱有的怀疑而选择中立性法官，保证法官能不偏不倚地作出裁判，保障诉讼公正的制度。从现行法律及司法解释对回避对象、事由、程序操作等规定来看，此制度尚需进一步完善。我国应重新界定法官范围．从适当扩大法官回避对象、细化明确回避事由、增设法院依职权裁定回避的方式等方面来保障法官回避制度的实现。
法官迴避製度，是為瞭消除噹事人對法官中立性抱有的懷疑而選擇中立性法官，保證法官能不偏不倚地作齣裁判，保障訴訟公正的製度。從現行法律及司法解釋對迴避對象、事由、程序操作等規定來看，此製度尚需進一步完善。我國應重新界定法官範圍．從適噹擴大法官迴避對象、細化明確迴避事由、增設法院依職權裁定迴避的方式等方麵來保障法官迴避製度的實現。
법관회피제도，시위료소제당사인대법관중립성포유적부의이선택중립성법관，보증법관능불편불의지작출재판，보장소송공정적제도。종현행법률급사법해석대회피대상、사유、정서조작등규정래간，차제도상수진일보완선。아국응중신계정법관범위．종괄당확대법관회피대상、세화명학회피사유、증설법원의직권재정회피적방식등방면래보장법관회피제도적실현。
The judge withdrawal system ensures that the judge impartially makes the decision to achieve justice. From the existing law and judicial interpretation, the withdrawal objects, the withdrawal causes and the operating procedures still have problems, So this system needs to be further improved. Our judges should be re- defined the scope, be appropriate to expand the judge objects. Meanwhile, the legislation should make the withdrawal reasons more clear, and increase the court to determine the withdrawal according to the law so as to protect the implementation of judge with drawal system.
