禁令制度是英美法系国家衡平法上的一种救济方式,其功能在于弥补普通法救济之不能,具有事前防卫侵害发生或侵害后果扩大的特点。我国目前在知识产权保护领域已初步建立禁令制度,但在理论基础、具体程序、司法实务等方面均存在着明显的不足。为完善我国知识产权保护制度,应在此次民事诉讼法修订过程中,对禁令制度的功能、地位和程序作出规定,加强该制度与民事保全制度、调解和解机制、执行程序的衔接。

The Injunction System（IS） is a main relief for equity law in countries adopting the Anglo-American law system.The function of IS is to remedy the inadequate relief functions of common laws in the following ways： preventing infringements before wrongdonings,and preventing the expansion of consequences of infringements.Currently in China,although an elementary IS has been established in the sphere of protection of intellectual property rights,there are obvious defects in terms of theoretical foundation,specific procedure,legal practice and so on.this paper argues that,in order to improve China＇s system for protecting intellectual property rights,the function,status and procedure of IS should be stipulated in the present amendment of Civil Procedure Law and that the connection and cohesion between the IS system and the civil conservatory system,reconciliation system and enforcement procedure should be strengthened.
