当前国际产业转移呈现出产业转移的主体更多更广,承接的难度更大、层级更高,产业转移的规模更大、周期更短;高技术产业转移与传统产业改造并举,战略性新兴产业成为产业转移的新焦点,项目外包成为产业转移的新主流,服务业转移成为新热点等诸多特点。产业转移过程中的政府规制存在规制俘虏、规制越位与缺位共存、规制机构组织要素失衡等规制失范问题。提出了建立完善的法律制度和完善政府规制政策,引导传统产业转移;建立独立高效的政府规制机构与加强司法审查并重,保障传统产业转移;合理界定政府规制的边界和范围,防止政府规制越位和缺位,激励传统产业转移;加强社会参与和完善监督机制,保护传统产业转移等对策建议。

At present, the characteristics of international industrial transfer showing that the main body of industrial transfer getting broader and there being more difficult and higher level to undertake, the scale getting larger and cycle getting shorter, transfer of high - tech industry and transformation of traditional industries being implemented simultaneously, strategic and emerging industries having become the new focus, outsourcing having become the new mainstream and service in- dustry having become the new hot spot. There are many problems of government regulation anomie in the process of in- dustrial transfer such as regulatory capture, regulatory offside and absence, imbalance among the organizational elements of regulatory agencies. So in the paper we make a number of policy proposals. First, we should establish a sound legal system and improve the government regulation policy to guide the transfer of traditional industries. Second, we can build an independent and efficient regulatory agency and strengthen the judicial review together to protect the transfer of tradi- tional industries. Then, it is necessary to define the boundaries and scope of government regulation reasonably, preven- ting from the offside and absence of government regulation. Last but not tile least, we should encourage the transfer of traditional industries, strengthen social participation and improve the supervision mechanism to develop the transfer of traditional industries.
