随着私家车的普及，无偿搭乘交通事故不断增多。但引发交通事故后的责任划分和相关损害赔偿，我国法律至今没有明确的规定，从而导致司法审判无法可依，出现司法割据的局面。各地法院通过内部规定或参照民法相关规定来指导、解决个案或者类案。私家车无偿搭乘交通事故与一般的交通事故存在很大区别，过错责任原则应成为处理此类案件比较恰当的归责原则，双方均无过错，可适用公平责任，分担民事责任。

If the two sides are not guilty, the principle of justice can be applied, and the civil liability can be shared.
