司法话语权，就是在司法过程中参与者的言说资格和行为资格。而所谓司法话语权的评判要素，就是构成司法话语权如何判断作为司法话语权的前提、基础、核心概念等的要素，如多元性、平等性和理性；如何判断在司法话语权行使过程中，如公共利益、公民社会和参与的不同作用；如何判断司法话语权的行使质量，如司法协商、司法共识和合法性结果等等。
