近十年来,随着我国石油产业国际化步伐的加快,中国石油企业开展国际合作的模式日趋成熟,合作合同的规范化需求也在不断提高。现行石油合作合同存在的规范概括、效力层次较低,石油勘探、开发、生产和销售各合作阶段合同的标准化、合作方主体资格的规范、合同的重新谈判等问题亟待关注。从法律角度对我国石油合作合同进行系统梳理和分析,对完善我国石油合作开发法律制度和石油合同管理具有重要意义。

Over the past decade,with the rapid internationalization of China＇s oil industry,the international cooperation models that Chinese oil companies carried out are more and more mature,and the needs of standardization of cooperation contracts are increased gradually.The standardized generalization and effectiveness of the current petroleum cooperation contract are in low level.The issues that we should pay a close attention include the standardized contracts of crude oil exploration,exploitation,production,and sales,the specifications of the qualification of partners,as well as the renegotiation of contracts.It is important to perfect the legal regime of China＇s oil international co-operation of exploitation and contracts management that we analyze the oil cooperation contracts systematically in China in the view of law.
