在以控辩式审判方式改革取得重要进展的背景下,能动司法理念的提出和司法新政的推行,可看做司法改革的延伸和进一步推进。回顾和考察坚持程序正义主导的审判实践,没有完全实现司法目标和满足人们的司法需求,但能动司法追求的司法目标不应是单纯的实体公正以及在此基础上社会目标的实现,同时也包含对程序公正的追求。本文认为,在遵从司法消极、克制性本质规律的前提和基础上,追求司法能动,达至程序公正和实体公正的平衡和契合,为能动司法的意旨所在。

With the adversarial trial system reform making significant progress, the introduction of judicial activism and the implementation of new judicial policies can be regarded as a further extension of judicial reform. However the objectives that judicial activism seeks should not simply be substantive justice, and the fulfillment of certain social objectives, but should also include the pursuit of procedure justice. This paper believes that, on the premise of abiding by such essential laws as judicial passivism and self-restraint, the ultimate purpose of judicial activism is to achieve a sort of balance and agreement between procedure justice and substantive justice.
