清刻本《旗亭记》以“雅雨堂两种曲”名义刊行，卷首未署名，因此其作者归属颇具争议。勾稽史籍、文集、笔记等并深入考辨后可知《旗亭记》原为金兆燕所作，后经卢见曾润色删改。《旗亭记》在作者归属上的争议，反映了清人著作权意识淡漠的普遍现象，而幕主与幕宾社会、经济地位不对等的主从关系，则是著作权发生争议的关键所在。
청각본《기정기》이“아우당량충곡”명의간행，권수미서명，인차기작자귀속파구쟁의。구계사적、문집、필기등병심입고변후가지《기정기》원위금조연소작，후경로견증윤색산개。《기정기》재작자귀속상적쟁의，반영료청인저작권의식담막적보편현상，이막주여막빈사회、경제지위불대등적주종관계，칙시저작권발생쟁의적관건소재。
The authorship of the version of controversial as the author＇s name was not affixed name of Two Dramas of Yayutang. After in-depth Qitingfi （《旗亭记》） in Qing Dynasty has remained on the front page when the book was published in the textual study of relevant historical records, anthologiesand notes, this paper holds that Qitingji was written by Jin Zhaoyan （金兆燕）and polished by Lu Jianzeng（卢见曾）. The argument about the authorship shows that scholars in Qing dynasty were generally indifferent to the right of author, and that the crux of the issue is the inequality in social and economic status between the sponsors and their dramatists.
