韩国通过制定、实施资本市场法,进一步完善了对内幕交易行为的规制力度。该法扩大了内幕人员和内幕信息的范围,强化和完善了对公开收购、大量取得或处分股份过程中的内幕交易行为的规制,完善和强化对内幕交易行为的民事、行政和刑事责任等。在我国完善证券法、期货交易法律、刑法等立法过程中,韩国资本市场法的许多规定和做法均值得我国借鉴。
韓國通過製定、實施資本市場法,進一步完善瞭對內幕交易行為的規製力度。該法擴大瞭內幕人員和內幕信息的範圍,彊化和完善瞭對公開收購、大量取得或處分股份過程中的內幕交易行為的規製,完善和彊化對內幕交易行為的民事、行政和刑事責任等。在我國完善證券法、期貨交易法律、刑法等立法過程中,韓國資本市場法的許多規定和做法均值得我國藉鑒。

Korea has improved its regulation of insider trading greatly by performing Korea＇s new made law-Capital Market Law.The law broadens the scope of insiders and inside information,strengthens and improves the regulation measures to insider trading in the course of the public tend offer and acquiring or disposing of the stocks,etc.Meanwhile,the law strengthens the civil,administrative and criminal punishment system so as to build a more perfect regulation system to prevent and abolish insider trading.It is worth studying in the course of improvement of amendment of Chinese security law or futures trade law and etc.
