法院的强制执行权缺乏有效监督是导致＂执行难＂与＂执行乱＂的重要原因之一。我国民事执行监督体系的完备离不开多种监督机制的相互配合与协调。法院的内部监督虽有缺憾,但单纯强化检察机关对执行的监督也并非最佳选择。可以考虑构建以执行救济为核心,以法院内部监督为支撑,以适当的检察监督等外部监督为补充的执行监督体系。

Deficient surveillance in law execution is one of the key reasons for the present chaotic and difficult state to have come into being.In fact,the perfection demands the coordination of multiple systems of surveillance.Flaws there are in the internal supervision,but mere emphasis on that of procuratorial organs upon the execution is not the best choice at all.Rather,it is better to construct a system that focuses on execution,along with internal surveillance of justice court and proper procuratorial supervision as supplementary means.
