我国陪审制度之“陪”，从清朝末年的引进，发展到如今的人民陪审员制度，其中内含了多重的语义和价值吁求。现行立法中的“人民陪审员”，既不是英美法系大众化的“陪审团成员”，也不是大陆法系专家化的“参审员”。人民陪审员制度的改革，应当把握人民陪审之“陪”的语义及其折射的伦理价值需求，在达成共识的基础上，平衡和协调民意监督、政治民主和司法借力这“三重价值期望”，保证人民陪审员的实质性参与，将现行人民陪审员制度“一分为三”：根据不同情况分别实行人民陪审团制度、机册（人民）陪审员制度和专册（人民）陪审员制度，真正实现人民陪审的司法借力和“民主”功能。
아국배심제도지“배”，종청조말년적인진，발전도여금적인민배심원제도，기중내함료다중적어의화개치우구。현행입법중적“인민배심원”，기불시영미법계대음화적“배심단성원”，야불시대륙법계전가화적“삼심원”。인민배심원제도적개혁，응당파악인민배심지“배”적어의급기절사적윤리개치수구，재체성공식적기출상，평형화협조민의감독、정치민주화사법차력저“삼중개치기망”，보증인민배심원적실질성삼여，장현행인민배심원제도“일분위삼”：근거불동정황분별실행인민배심단제도、궤책（인민）배심원제도화전책（인민）배심원제도，진정실현인민배심적사법차력화“민주”공능。
The ＂accompanying＂ of our ＂jury＂ or ＂assessor＂ system remains multiple semantic and value appeals from the end of the Qing Dynasty to now. Our current ＂people＇s assessor＂ is neither the ＂member of jury＂ in the common law, nor the ＂expert assessor＂ in the continental law. We should get the ethic value demand in the semantic refraction of the＂accompanying＂ of our ＂people＇s assessor system＂ in order to dismiss the problems in reform and misunderstanding, and coordinate the ＂three value expectations＂ of public opinion supervision, political democracy and justice on a consensus basis to ensure the substantive participation of the people＇s assessors in cases. Only dividing the currentpeople＇s assessor system into three as follows： the people＇s jury system, the machine registering （people＇s） assessor system and the special books （people＇s） assessor system can we truly enlist the help of the people＇s assessor system to the justice and realize its democratic function.
