我国近期揭露的一系列食品安全问题表明,传统法人犯罪控制策略面临风险社会的严峻挑战：一是对＂重刑主义＂刑罚观的挑战,二是对法人犯罪中责任主体与责任分配原则的挑战。因此需要引导公众认同法律规范价值,加强行业监督与监管层级,划定法人责任与雇佣责任的范围,正视风险社会的结构品质,在风险社会的结构性困境中完善归责体系,以期取得法人良性发展与社会安全的双重收益。

Recently,a series of problems of food safety have been exposed to the public.It is depicted that former strategies of controlling corporate crime is facing severe challenge from risk society.One is from the severe-penalty doctrine,which is implemented to prevent crimes;the other is from the liability subject and the responsibility distribution.Therefore,it is necessary to guide public to approve the value of regulations of laws and define corporate responsibility and employer＇s liability.Meanwhile,structural characteristics of risk society should not be neglected,so that we could improve the responsibility system in risk society in order to acquire double benefit of the benign development of enterprises as well as social safety.
