渎职侵权犯罪侦查权是法律监督权的重要内容和运行保障。目前检察机关的侦查职权存在严重不足,无法适应对渎职侵权犯罪的侦查要求。因此,针对渎职侵权犯罪,应当扩充检察机关侦查职权,赋予其技术侦查手段和特别调查权,增加强制措施执行权,尤其是拘留和逮捕的执行权。侦查权的配置可以通过刑事诉讼法的修改来实现,并可以考虑单独立法,构建以检察机关为主导的积极、主动的反腐败体系。

The investigation power to malfeasance crimes is an important part of the legal supervision power.There is a serious shortage of investigation powers,which cannot adapt to the requirements of investigation to crimes.Therefore,the investigation powers of prosecution should be expanded,given its technical investigation measures and special investigative powers,and increase the powers of enforcement measures,in particular the executive power of detention and arrestment.This can be achieved through amendments to the Criminal Procedure Law.In addition,independent legislation may be considered to construct the positive anti-corruption system led by the procuratorate.
