应然权利与实然权利既是权利文化中的客观现象,也是权利学说中的重要问题。对应然权利与实然权利的划分,是自然法理论的产物,应然权利从价值层面对权利的应该状态作出描述,实然权利则从事实层面揭示权利的实际状态。二者既有明显区分,又有高度统一,并在对立统一中推动权利文化的进步。应然权利向实然权利的转化,应具有坚实的物质基础、良好的社会文化环境、优良的制度条件和有效的保障机制。

The natural right and legal right are objective phenomena in rights culture, and also they are important problems in rights theory. The divide of natural right and legal right is from the theory of natu- ral law , natural right is the natural state of rights and legal right is the actual state of rights. Natural right is apparently different from legal right, but they are highly uniform on the other hand. To transform natural right into legal right, it is necessary to have enough material basis, good cultural environment, excellent system condition ,and effective relief mechanism.
