In measuring patent infi＇ingement damages, the apportionment rule has been found as a solution to prevent the over-compensation and unlawful expansion of the scope of the patent resulting by the application of the entire market value rule. Under the apportionment rule, the overall value of the infiinged product that is allributable to the infringed patented technology is identified. The apportionment rule, used in the U.S. for more than 100 years, can be applied to identify patent infringement damages in China, which will lead to the perfection of the damage system.
