食品监管渎职罪是《刑法修正案（八）》新增的一个渎职罪。从立法规定看,本罪的实行行为表现为滥用职权行为或者玩忽职守行为。作为本罪的构成要件,发生重大食品安全事故或者造成其他严重后果是本罪的渎职结果,其与行为人的渎职行为具有刑法上的因果关系是行为人承担本罪刑事责任的客观根据。尽管立法没有对本罪的主观罪过形式作出明确规定,但其并不是复合罪过形式,仍然是单一罪过形式,因此,在具体处理案件时,应结合其实行行为来确定行为人的罪过形式。
食品鑑管瀆職罪是《刑法脩正案（八）》新增的一箇瀆職罪。從立法規定看,本罪的實行行為錶現為濫用職權行為或者玩忽職守行為。作為本罪的構成要件,髮生重大食品安全事故或者造成其他嚴重後果是本罪的瀆職結果,其與行為人的瀆職行為具有刑法上的因果關繫是行為人承擔本罪刑事責任的客觀根據。儘管立法沒有對本罪的主觀罪過形式作齣明確規定,但其併不是複閤罪過形式,仍然是單一罪過形式,因此,在具體處理案件時,應結閤其實行行為來確定行為人的罪過形式。

The crime of dereliction of duty on food supervision and management is one of crimes of dereliction of duty newly provided in the Amendment XIII to the Criminal Code. From the legislative provision, its practice behavior manifests a behavior of abusing power or neglecting duty. As one of elements of crime composition, causing major food safe accident or other serious consequence should be the result of dereliction of duty, and the causality between it and behavior of derelic- tion of duty is objective basis on which he undertakes criminal responsibility. Although not clearly defined in legislation, the subjective form of the crime is not compound, but a single one. Therefore, during disposing of cases, the subjective form of crime should be determined combining with practice behavior.
