当前,中国的再审制度改革与实践面临诸多难题。从再审制度与涉诉信访、审级制度的外部关联以及其与再审主体的内在冲突关系之中,可以清楚看出,再审制度的合理性因素以及制度角色与制度能力明显不足。因而,从制度的外部关联与内在结构的双重角度对其进行观察与分析,并在此基础上对其进行审慎改革无疑十分必要。而要重构当前的再审制度,不仅要修正再审的理念,而且要完善再审制度的结构原理,以便进一步推进当前中国再审制度的实践,推动司法制度的发展,改善司法权威形成的内外部环境。

At present,China is facing a lot of problems in reforming and implementing its rehearing system.An examination of the connections between the rehearing system and some external factors（e.g.complaints concerning legal cases made through letters and visits and the system of judicial hierarchy） and of the internal conflicts between different parties involved in the rehearing process reveals that the rehearing system,based on shaky ground,is inadequate to meet our legal needs.Therefore,it is necessary to initiate a prudent reform of the current rehearing system on the basis of due observation and analysis of its external connections and internal structure.A transformation of the current rehearing system does not only involve a revision of the concept underlying it,but improves its structure as well so as to streamline the current practice of rehearing,promote the development of the judicial system,and create a favorable environment for establishing the social confidence in judicial authority.
