当前的承包经营权制度已表现出主体范围封闭、承包经营权权能不完整、不充分、弱保护性、弱稳定性等缺陷,并导致了承包经营权易受行政权力的支配与侵害,农民对土地的投入缺乏保证及细碎化的经营等,因此,承包经营权主体范围应有限封闭,使土地承包经营权权能完备,充盈并强化承包经营权的保护,以实现承包经营权由实然状态向应然状态的持续跃进。
噹前的承包經營權製度已錶現齣主體範圍封閉、承包經營權權能不完整、不充分、弱保護性、弱穩定性等缺陷,併導緻瞭承包經營權易受行政權力的支配與侵害,農民對土地的投入缺乏保證及細碎化的經營等,因此,承包經營權主體範圍應有限封閉,使土地承包經營權權能完備,充盈併彊化承包經營權的保護,以實現承包經營權由實然狀態嚮應然狀態的持續躍進。

There are several shortcomings of the current contractual operation right system, such as the closeness of main scope, the unintegrity, insufficiency, the weak protection and the unstableness and so on. Sometimes administrative power is ultra vires contractual right. And the investment on the land from farmers is restricted within narrow limits, which cause the separate land orperation. In the paper, some countermeasures such as the limited openness of operation subjects and the protection the contractual operation right, are provided to promote the further development of contractual operation right.
