中国传统的社会秩序寓于传统的乡村社会结构之中。新中国建立后传统社会结构发生了根本性的变化,然而,乡村社会还是处于向现代社会的慢速转型时期,乡村秩序的基础仍然有传统社会的印记,社会结构的变化并没有使人们产生法治意识。随着城市化进程的加快,农村社会进入了前所未有的快速转型时期,原有的农村社会结构趋于解体,适应农村社会结构的变化,需要建立法治基础上的新的社会秩序。

The traditional Chinese social order is embodied in the traditional rural social structure. After the founding of People＇s Republic of China, the traditional Chinese social structure has been subject to fundamental changes, However, the rural society is still in the slow transition of becoming increasingly modernized, and the foundation of rural social order is still marked with traditional heritage, therefore the transition of Chinese social structure has not triggered people~ s legal consciousness. With the process of urbanization speeding up, the Chinese rural society has entered the unprecedentedly rapid transformative period, during which the traditional rural social structure tends to gradually disintegrate, and the new social order must be established on a legal basis in order to fit in with the changing rural social structure.
