代位权作为债的保全制度之一，其设立的目的在于督促债务人积极追索其拥有的债权，以维护债权人的利益。我国的代位权制度在维护债权人利益的同时，在立法上却忽略了债务人的利益保护。必须从多个层面修改和完善代位权制度，以期达到在维护债权人利益的同时，亦防止损害债务人利益。
대위권작위채적보전제도지일，기설립적목적재우독촉채무인적겁추색기옹유적채권，이유호채권인적이익。아국적대위권제도재유호채권인이익적동시，재입법상각홀략료채무인적이익보호。필수종다개층면수개화완선대위권제도，이기체도재유호채권인이익적동시，역방지손해채무인이익。
Subrogation as one of the debt security systems is to urge the debtors set up their own positive claims of recourse to safeguard the interests of creditors. Our subrogation system is also established for this purpose. However, it neglects in legislation to protect the interests of the debtors. We should improve the subrogation system to well protect the interests of the creditors, and to protect the interests of the debtors as well.
