超期羁押是指刑事诉讼活动中办案机关依法羁押犯罪嫌疑人或被告人之后,超过法定的羁押期限而继续羁押的行为。超期羁押是司法实务中的一大顽疾,存在于侦查、起诉、审判各个阶段。通过对2000—2010年C市某中级人民法院赔偿委员会受理的赔偿案件进行数据分析,结合新旧《国家赔偿法》的规则考量,借《刑事诉讼法》修改之际,强化个案正义与公民权利的价值追求;在重视法律文本考察和案例数据分析的基础上,分析已经发生的抑或可能发生的超期羁押现象并提出针对超期羁押的国家赔偿对策,主要是实现精神损害赔偿的完善、赔偿审判机构的建设、听证制度的设立。

Extended custody aims to continue custody behavior which has extended legal custody time limit after the organ handling the case legally detains criminal suspects or defenders in penal proceeding activities and is a difficult step in judicial practice during each period of investigation,lawsuit and trial.Through data analysis of the compensation cases accepted and heard by Compensation Committee of Intermediate People’s Court in C City,by combining the consideration of the provisions in new and old National Compensation Law,by consolidating individual cases justice and value pursuit of civic rights at the time of the revision of Penal Proceeding Law and on the basis of emphasizing law text examination and cases data analysis,this paper analyzes the extended custody cases which have taken place or which will take place and realizes the perfection of trauma compensation,the construction of judicial organs and hearing system set-up according to national compensation measures for the extended custody.
