随着经济的快速发展,统筹城乡发展的力度加大,城市化进程跨入高速时代。在农村集体土地被征用过程中,因利益分配产生的人民内部矛盾日益凸显,无论是征地补偿费的分配、还是土地承包合同纠纷的解决,均涉及农村集体经济组织成员资格的认定问题,其直接涉及到村民的切身利益,而在司法实践中,集体经济组织成员资格认定问题却争议颇多。因此,正确厘清成员资格的界定标准、确认部门和救济途径,以及在我国现行法律下的可行性操作,是和实践关系密切具有现实意义的课题。
