现行行政诉讼法启动我国行政公益诉讼程序的“天然”缺陷，导致“事不关己”的我国行政公益诉讼无一例外地陷入困境，亟需在立法上构建与之相应的制度。三种行政公益诉讼启动程序各有利弊，而三元式启动程序最佳，必须在坚持三元式启动程序的前提下，在现行行政诉讼制度中设置三种机制，以完善检察机关启动我国行政公益诉讼程序。
現行行政訴訟法啟動我國行政公益訴訟程序的“天然”缺陷，導緻“事不關己”的我國行政公益訴訟無一例外地陷入睏境，亟需在立法上構建與之相應的製度。三種行政公益訴訟啟動程序各有利弊，而三元式啟動程序最佳，必鬚在堅持三元式啟動程序的前提下，在現行行政訴訟製度中設置三種機製，以完善檢察機關啟動我國行政公益訴訟程序。
현행행정소송법계동아국행정공익소송정서적“천연”결함，도치“사불관기”적아국행정공익소송무일예외지함입곤경，극수재입법상구건여지상응적제도。삼충행정공익소송계동정서각유리폐，이삼원식계동정서최가，필수재견지삼원식계동정서적전제하，재현행행정소송제도중설치삼충궤제，이완선검찰궤관계동아국행정공익소송정서。
The relative systems in the field of the existed administrative public welfare lawsuit in starting must be constructed based on the conditions of the ＂natural＂ shortage caused by the things not affecting oneself. There are advantages and disadvantages in three kinds of starting process while the three-way start-ups of administrative public welfare lawsuit are the best. It may establish the three kinds of mechanisms under the start-ups of administrative public welfare lawsuit of the three -way to complete the administrative public welfare lawsuit on the base of the three-way start-ups of lawsuit.
