话语与权力紧密相连,权力是通过话语表现的。在作为机构话语的法庭话语中,庭审参与各方的话语权力形成了一个连续体,律师的话语权力位于法官和公诉人之后,但又远大于原被告和证人。为了展现不同类型案件中律师话语的权力控制情况,以9场庭审话语的转录语料为研究样本,从律师的问话与答语两个方面,描述了律师话语与权力控制的关系。

Discourse and power are closely interlinked, and power is manifested through discourse. In the courtroom discourse, as a typical type of institutional talk, all the discourse power of participants of the trial forms a continuum. The power of the lawyer is less than that of the judge and the prosecu- tor, but far more than that of the plaintiff, the defendant and the witness. In order to demonstrate how power manipulates lawyers＇ discourse in different types of cases, based on the authentic record-tran- scriptions of the trails, this paper depicts the relationship between lawyers＇ discourse and the corre- sponding power manipulation, from the perspectives of lawyers＇ questions and responses.
