我国宪法和刑事诉讼法确立了检察机关对侦查权进行法律监督的原则,其内容含有控制之义,但控制权限不够,监督的方式具有片面性。考察国外检警关系模式,分析我国检警关系的现状和不足,针对我国检察机关对立案监督消极被动、监督缺乏强制力、提前介入缺乏规范性、强制监督不力等问题,提出以＂检察控制侦查＂的监督模式来重新建构我国的检警关系。
我國憲法和刑事訴訟法確立瞭檢察機關對偵查權進行法律鑑督的原則,其內容含有控製之義,但控製權限不夠,鑑督的方式具有片麵性。攷察國外檢警關繫模式,分析我國檢警關繫的現狀和不足,針對我國檢察機關對立案鑑督消極被動、鑑督缺乏彊製力、提前介入缺乏規範性、彊製鑑督不力等問題,提齣以＂檢察控製偵查＂的鑑督模式來重新建構我國的檢警關繫。

According to China＇s Constitution and the Criminal Procedure Law,the procuratorial organs are authorized to execute legal supervision of investigation. This principle embodies the power of control, though rather limited with one - sidedness of supervising methods, Based on a comparison with the procurator police relationship in foreign countries ,this ar- ticle makes an analysis about the status quo and inadequacy of this relation in China, and puts forward a proposal that we should adopt a mode of ＂investigation under procuratorial control＂ to rebuild the relationship between the procurator and the police.
