现代的消费市场,因消费纠纷而涉及诉讼的,大多数属于集团诉讼,依据我国大陆（下称大陆）现行法律,消费者维权方面出现了立法上的不足,难以落实对消费权益的保护。通过引述我国台湾地区相关立法的框架及其内涵,分析了该制度是一种新型的维权制度,且表述该制度对消费者的意义。通过论证认为,我国大陆有必要构建消费集团诉讼。

In modern consumer market, most of the litigations concerned due to the consumption＇s dispute are of the class lawsuits. According to the relative laws in Mainland of China, it appears obviously that the relative regulations regarding the consumer protection aren＇t enough. Under this circumstance, it is unable to protect the consumers＇ right. From this issue, the author explores Taiwan＇s legal framework about the consumer class lawsuit system and its＇ contents firstly; then analyses that the consumer class lawsuit system is a new system of the rights protection; and also expresses that this system is of significance for the consumers. It is conclusive that the system could be constructed for China＇s revelation.
