2010年出台的《社会保险法》在基本养老保险方面更加注重保障参保人的权利,确立了覆盖城乡全体居民的基本养老保险制度法律框架,在参保范围及养老金领取制度方面都取得重大进展,但仍存在一些尚未解决的问题,如怎样实现社保基金的全国统筹、实现社保关系异地转移等。解决思路是尽快制定一系列配套的法律法规,并遵循城乡统筹、利益均衡原则,建立全国养老保险垂直管理体系,将＂新农保＂政策制度化等。

The promulgation obS6cial Security Law pays more attention to protect the rights of the insured in the basic pension insurance, establishes a legal framework for the basic pension insurance system cov- ering urban and rural residents, and has made a significant progress in terms of the insurance scope and pension system. But at the same time, it exposes some imperfections, such as the ways to make national co-ordination of social security fund and to make the pension continuity to transfer in differ- ent places. The solution is to develop a series of supporting laws and regulations as soon as possible, and establish a vertical management system of the national pension insurance according to the princi- ple of overall-planning the urban and rural areas and balancing their interests, so as to institutionalize the new rural social security policy.
