美国司法界在判例法传统下形成了较为完善的司法信息公开制度。公众对司法程序及司法记录的知情权得到保障，并通过利益衡量机制对公众知情权进行了必要的限制。但是信息时代背景下远程公开方式对美国传统的司法信息公开制度带来了挑战，在各方争论中，美国司法界采取有限制的远程公开思路，按照信息内容、案件类型区别公开，并利用XML技术对敏感信息进行识别、处理。当前，我国的司法信息公开制度处于传统司法信息公开与远程司法信息公开交错发展的新阶段，传统司法信息公开尚未建立健全，远程司法信息公开的挑战却又如期而至，因此美国的经验值得我们借鉴。

American judiciary has already formed a relatively perfect system of access to judicial information by case law. Public＇s right to know about judicial process and records had been protected, and it had been restricted by the mechanism of balancing interests. However, in this Information Age, the remote access brought about much challenge for traditional access to judicial informatiom. After much arguing, the American judiciary adopted limited reinote access, that is, distinguishing the judicial information according to different content of information and different type of cases, and using XML technology to identify and deal with sensitive information. At present, China＇s judicial information publicity system is still in the early stage and it has more defects in remote access. So it is worthy to learn from the American experience.
