和解合同是当事人约定互相让步,以终止争执或排除法律关系不明确之状态的合同。和解合同的构成要件有三：第一须有争执或法律关系不明确之状态的存在;第二须有终止争执或排除法律关系不明确状态的意思;第三须有相互让步。和解合同具有确认的效力与和解合同对当事人和第三人的效力以及效力障碍等问题,和解合同撤销的情形有,诸如和解与欺诈、胁迫、显失公平和错误制度。
和解閤同是噹事人約定互相讓步,以終止爭執或排除法律關繫不明確之狀態的閤同。和解閤同的構成要件有三：第一鬚有爭執或法律關繫不明確之狀態的存在;第二鬚有終止爭執或排除法律關繫不明確狀態的意思;第三鬚有相互讓步。和解閤同具有確認的效力與和解閤同對噹事人和第三人的效力以及效力障礙等問題,和解閤同撤銷的情形有,諸如和解與欺詐、脅迫、顯失公平和錯誤製度。
화해합동시당사인약정호상양보,이종지쟁집혹배제법률관계불명학지상태적합동。화해합동적구성요건유삼：제일수유쟁집혹법률관계불명학지상태적존재;제이수유종지쟁집혹배제법률관계불명학상태적의사;제삼수유상호양보。화해합동구유학인적효력여화해합동대당사인화제삼인적효력이급효력장애등문제,화해합동철소적정형유,제여화해여기사、협박、현실공평화착오제도。
The settlement contract is one contract that its parties agree to mutual concessions,to terminate the contract dispute or exclude the not clear status of the legal relationship.The constitutive requirements of the settlement contract are as following： the existence of not clear state,the declaration of will to terminate the contract dispute or exclude the not clear status,mutual concessims.This contract not only has determinate effect,also has effect on the parties and the third person,and the barrier of validity.The cancellation of the contract has several cases,such as reconciliation and fraud,duress,obvious,and error system.
